On June 15, 2006, Attorney Michael J. Petro won a 4th Amendment suppression hearing related to a gun found in his client's vehicle during a traffic stop. The case was litigated in front of the venerable Judge Fred Suria.
Judge Suria has since retired after 42 years on the bench. His presence will be sorely missed by the Chicago legal community and Mr. Petro.
After testimony at the suppression hearing, Attorney Michael J. Petro argued that the gun was found during an illegal inventory search of his client's vehicle. In short, Mr. Petro argued that the police had no right to inventory and search the vehicle because a licensed driver in the vehicle at the time of the stop was available to drive the car from the scene.
Judge Suria agreed. The gun was supressed and the case was dismissed.
