Attorney Petro Secures Dismissal in Serious Pinellas County Drug Case
Attorney Michael J. Petro is pleased to announce a successful defense result: Pinellas County drug charges dismissed against Mr. Eric Eugene Mozell, Sr. after Attorney Petro filed a Motion to Suppress challenging the legality of the traffic stop and vehicle search. The case involved serious allegations of trafficking in cocaine and possession of marijuana in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, Case No. 25-09513-CF.
Attorney Petro Challenged the Legality of the Traffic Stop
Attorney Petro filed a Motion to Suppress Evidence, Statements, and All Fruits of the Stop, arguing that the traffic stop and later warrantless search violated Mr. Eric Eugene Mozell, Sr.’s constitutional rights. The motion challenged the State’s claimed basis for the stop and pointed out that the arrest paperwork contained inconsistent explanations for why Mr. Mozell’s vehicle was stopped in the first place.
Motion to Suppress Targeted Evidence, Statements, and Fruits of the Search
Attorney Petro argued that one affidavit did not identify any traffic violation or specific unlawful act supporting the stop, while another affidavit claimed that Mr. Mozell made a turn without using a signal. Attorney Petro argued that the alleged turn-signal violation did not automatically justify the stop under Florida’s turn-signal statute, because Florida law requires a fact-specific analysis of whether another vehicle was affected by the movement. Attorney Petro also argued that facts allegedly discovered after the stop—such as odor, plain-view observations, or items later found during a search—could not be used to retroactively justify the original seizure.
The motion sought suppression of all physical evidence, statements, observations, and derivative evidence obtained as a result of the stop and search. In serious drug cases, a successful suppression motion can be case-dispositive because the State may be unable to proceed if the evidence was obtained unlawfully.
State Dismissed the Charges Before the Suppression Hearing
Before the scheduled hearing on the motion, the State filed a Nolle Prosequi, dismissing the charges against Mr. Mozell. The filing stated that further investigation by the State Attorney’s Office revealed that further prosecution was not warranted.
